Constitutionalization of politics is inseparable from another important process occurring in contemporary political systems – politicization of the constitutional discourse. In various jurisdictions charges of unconstitutionality or claims regarding “proper” constitutional interpretation are used instrumentally to advance the agendas of political actors. The panelists will examine how constitutional arguments are used in the political discourse both in established and young democracies (respectively Italy and Bulgaria), as well as by authoritarian regimes. The research findings may bring a new contribution to the debate on how constitutional interpretation serves as a legitimization of power in contemporary states.
