Abstract

Cross-border worker mobility in the EU takes many forms and has greatly increased over the last two decades. EU citizens may use the free movement of workers, the freedom of establishment or the freedom to provide services to work in other EU member states. Workers increasingly cross intra-EU borders and employers benefit from the many opportunities of an EU-wide labour market. However, these freedoms of labour mobility come with manifold difficulties for member states, employers, employees, and of course for the dynamics in the EU itself. Worker protection of mobile employees has become increasingly complex and poses challenges to the member states in terms of social security coordination as well as enforcement of labour rights. Moreover, trends such as the posting of third country nationals and unexpected events such as the Covid-19 pandemic introduce additional obstacles of cooperation and enforcement to the agenda. This panel examines how member states/different actors navigate these challenges. How are member state administrations dealing with their obligations under EU law to cooperate horizontally, e.g. regarding the social insurance of posted workers, and not to unduly restrict free movement, despite limited knowledge about potentially restrictive cross-border effects of their actions? How do different member states balance the costs and benefits of cooperation? The papers in this panel address forms of cooperation and coordination regarding cross-border labour mobility in Europe and examine aspects that hinder or facilitate this cooperation along the lines of member state and EU competences and interests in an enlarged single market.
