The purpose of this Roundtable is to discuss the constitutional implications of the European multilevel system for the protection of fundamental rights. In the EU legal space, human rights are simultaneously protected in the constitutions of the member states, in the law of the EU, and the in the European Convention on Human Rights (ECHR). Yet, the European multilevel human rights system has recently been facing important challenges. On the one hand, an increasing number of EU member states has been calling into question respect for human rights at the domestic level, through changes in the national constitutional laws or practices. On the other hand efforts to make the EU become a member of the ECHR, have failed (see in this regard the recent Opinion 2/13 of the EU Court of Justice, striking down the draft accession agreement of the EU to the ECHR). The purpose of this panel, which brings together leading experts in the field of human rights, and multilevel constitutionalism, is to discuss the European human rights architecture in action – including by discussing some of the most important legal and political challenges of the day.
