Constitutionalization is a constant feature of American politics since the earliest years of the Republic. Nevertheless, its character, forms, and scope are always evolving. The panel includes papers on diverse aspects of this process, especially on the role of the legislative and executive branches. The panelists will examine constitutional interpretation by U.S. presidents, congressional investigations and related constitutional conflicts, and the outcome of executive constitutional politics in the form of the expansion of the presidential unilateral war powers. The papers will contribute to a broader discussion concerning the reasons and challenges stemming from the clash of law and politics in American constitutionalism.
