Abstract

The COVID-19 pandemic hit at a time when the EU project was already under strain from rising Euroscepticism within EU Member States as well as widespread criticism of the European Integration itself. The pandemic provides an additional layer of challenges for the cohesion and unity in the EU and for the proper application of the EU rules. These challenges manifest themselves in several of the key aspects on which the EU is based. New restrictions put in place by several Member States under the cover of the COVID-19 pandemic have severely restricted or even put a halt to the free movement of persons and the equal treatment of EU citizens. Likewise, the fundamental freedoms of assembly and expression have been curtailed on the basis of justifications which require critical examination. Lastly, the adoption of generous state aid measures under the cover of the pandemic arguably poses a considerable challenge to the existing EU rules and principles governing this field. This panel will reflect on the last years and the (legal) developments in the area of EU law. It will critically analyse how the EU and its Member States have reacted to the challenge of a global pandemic and assess whether the fundamental tenets of EU law in several fields survived, and reflect on possible ways forward.
