Federalism has long been a major political, institutional and constitutional response to reconciling conflicts that arise from aims of effective policy making and gaining legitimacy from citizens. In recent years, it has returned as a central issue politically in many areas of the world, not just the EU but also the Americas and Asia. Claims about the need for federalism to meet challenges such as increasingly internationalized policy-making while satisfying the demands stemming from diverse territories have met opposition from nationalist and populist parties as well as raised opposition towards adding unnecessary ‘bureaucratic superstructures’. They have also triggered conflicts in existing federations on which rules should apply federally and which should be decided at lower levels, all challenging the legitimacy of federal governance. This panel analyses some of the ‘federalizing processes’ which try to balance effectiveness and legitimacy at multiple jurisdictional levels, detect the mechanisms that set them in motion and explore the causes of their continuing evolution. It looks at international pressures arising from factors such as trade or war and cross-national learning as well as exclusively domestic conflicts. The panel seeks to elicit paper proposals on any of the following aspects: ▪️ theoretical refinements of the notion of federalism, to be broadly understood as "a general principle of order, combining unity with diversity" and a set of values (Keating 2017: 615) ▪️ historical mappings of past federalizing processes with a view of unearthing the forces pushing for federalization as well as those opposing it ▪️ analytical assessments of federalizing processes, addressing particularly the capacity to balance efficiency, legitimacy and expediency ▪️ empirical explorations of the novel forms that such processes may take, with a focus on the drivers and actors behind these processes ▪️ comparative analyses of federalizing processes at the national and regional level.
